Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle
The basketball icon, introducing himself formally in a Charlotte court on Friday, stated that his drive to win and novelty within the sport motivated his effort with 23XI Racing to confront Nascar over alleged violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared operational insights of his racing venture, saying he invested $40 million of his own funds into the Nascar Cup series team launched with partner Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”
Central Issue: Charter Agreements and Contract Pressure
At issue is the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with independent franchises, such as the Charlotte Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the global icon.
Leading the Legal Charge
23XI Racing is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is unlawful to maintain excessive control.
At issue for Jordan and Heather Gibbs, who testified before Jordan, are events from September 2024. Gibbs described a hectic and tense six hours where the racing circuit informed teams they had to sign a contract extension. The document spanned 112 pages outlining team compensation and a guaranteed entry in Nascar-sponsored races.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports decided their sole viable path was to decline to sign that extensive document and take the issue to court. All other teams agreed to the terms.
Jordan and co-owner Denny Hamlin reached out to Nascar about possible changes or negotiations. Nascar refused to engage, Jordan said.
The Ultimate Motivation: Winning
Ultimately, the pushback against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Winning.
“Denny convinced me getting a third driver improved our chances to win,” he said, noting that he bought a third charter last year for $28 million despite the uncertainty. “So I took the plunge.”
Account from the Gibbs Family
Heather Gibbs detailed her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the contract signing demand didn’t sit well.
According to her, Joe Gibbs first tried to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
